2 Missouri dads regain child custody after mom's flight with kids

Child custody disputes can be emotional and stressful for both parents, but two Missouri fathers are counting their blessings after their daughters disappeared. The mother fled the state with two of her children and was apprehended when she tried to cross the border into another country. The two girls were placed into protective custody until their fathers could get them back home.

The woman's ex-husband has primary child custody of one of the girls. The mother failed to return her 4-year-old daughter to him early last month after a standard weekend visitation, sparking the hunt for her and eventual arrest. The father holds authorities partly responsible for the delay in resolving the matter because they did not classify his daughter as a missing person until five days after the complaint came in. He claims they dismissed the matter as civil and not criminal. He credits public and media pressure for getting the matter upgraded.

The woman has since been arrested and is charged with a felony count of parental interference and a misdemeanor count of endangering the welfare of a minor. The other girl, a 16-year-old, is also in the custody of her father, though it's not known if he had primary custody of her before the mother's flight attempt.

When a parent interferes with custody, it can become a criminal matter, as this case reflects. In the eyes of the law, the overriding goal when addressing child custody issues is the best interests of the child. In most cases, that means developing a parenting plan that upholds the welfare of the child and the rights of both parents. Framing that plan and enforcing it when necessary is best done with the help of an experienced attorney.
