Missouri couple wins child custody battle again

Child custody cases can become complicated when multiple parties are involved. While some people may think that child custody cases only involve biological parents, that is not always the case. Recently, a Missouri couple won a case that involved a young child they had raised since he was a baby.

The couple started raising the then one-year-old child when his biological mother was involved in an immigration raid at a poultry plant. Her parental rights were then terminated. The mother challenged in 2012 a previous court decision involving the adoptive parents and the termination of her rights. The latest hearing upheld the previous decision which could make things easier for the adoptive parents as they continue to move forward. Although the case could still be challenged, it would have to be appealed to the Supreme Court.

Although the argument has been made that the biological mother did not receive proper representation and lost custody because she was here illegally, there has been other circumstances in addition that have helped the couple maintain custody. The woman did not attempt to maintain any type of relationship with the child while she was incarcerated. It was also stated that she did not attempt to provide for the child.

Any Missouri resident involved in a child custody case of their own could benefit from having an understanding of the applicable state laws. When complicated cases arise, it can be helpful if a person knows the best course of action to take and the proper steps to make the process as easy as possible. As is evident in this case, understanding one's rights and being persistent can help a person receive a successful outcome.
